"Yesterday at approximately
3:20 pm, jurors in the case of the US vs. Hollis Wayne
Fincher, found Fincher guilty. Jurors reportedly spent 5
hours deliberating, over what is uncertain, because they
were never allowed to hear much. Fincher was never able
to take the witness stand before jurors;
US District
Court Judge Jimm L. Hendren ruled that Fincher’s
testimony was inadmissible in court. The jury was only
allowed to hear exactly what Federal prosecutors wanted
them to hear, nothing more and nothing less.
The fact is, the Federal prosecutors cooperated quite
well with Judge Hendren in silencing Fincher.
They also kept Fincher and his
attorney from using the US and Arkansas constitutions
for defense. Apparently,
only judges and government officials have the right to
decide what the Constitution means or does not mean. The
average American doesn’t even have the right to
understand the very thing that was designed to protect
him!"

Fincher case - and the guilty verdict given to Mr.
Ficnher - is just
more proof
that we are no longer a free people.
We only think we are because that is what we have been
led to believe. Between government spin-doctors and the
biased media, we are constantly told that “freedom is

Freedom to twist their lies, and force-feed it to the
citizenry as truth?
When
it comes to freedom, and the documents that were
designed to protect us from government tyranny, the
Constitution and Bill of Rights as well as the
constitutions of the several States, it is only used

The president, Congress, our governors and our state
legislatures have failed to uphold their oaths of
office. They believe that those documents are only
pieces of paper, and are only useful when it is

60-year-old convicted in illegal-weapons case

FAYETTEVILLE -- A Washington County man faces up to 20
years in federal prison after a jury convicted him
Friday of illegal-weapons charges.
Hollis Wayne Fincher, 60, smiled at relatives and
supporters after the verdict was read in U.S. District
Court in Fayetteville. He will remain in the
Sebastian County jail in Fort Smith and will be
sentenced within 60 days.
The
jury deliberated more than four hours Friday before
convicting Fincher on charges of possessing machine guns
and possession of a firearm not registered in the
National Firearms Registration and Transfer Record.
Wendy
Johnson, assistant U.S. attorney, said the investigation
of the militia Fincher belongs to continues.
Fincher and his supporters "are good people, and they
believe very strongly," Johnson said.

Defense attorney Oscar Stilley said he plans to appeal
the case "until we get a not-guilty verdict."
He
said jurors appeared to have wrestled with the law as
they deliberated.
The
jury sent three questions to
U.S. District Judge
Jimm Larry Hendren,
including one asking how they could reconcile being
unable to make a unanimous decision on the registration
charge. They concluded deliberations two hours later.
"I
don't feel like they were happy about this [decision],"
Stilley said, "There were no smiles on their faces and
no laughing."
Fincher is the lieutenant commander in the Militia of
Washington County and never denied owning the guns.
Other militia members expect to be arrested on federal
gun charges, Stilley said.
The
U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives
began investigating Fincher in May, several months after
he appeared on the front page of a newspaper holding a
machine gun.
Fincher's "beliefs are so strong, and it's in his heart
and in his soul," Stilley said. "Why else would you
stand in front of a camera holding a machine gun?
The
defense is planning to ask Hendren to sentence Fincher
to 30 months in federal prison, the sentence prosecutors
offered Fincher if he would have pleaded guilty, Stilley
said.
"There are a lot of prices you have to pay to have your
day in court," Stilley said.
The
defense put no witnesses on the stand. **

Federal Judge Hendren illegally denied allowing Lt.
Commander Wayne Fincher or other defense witnesses to
take the stand was omitted from this newspaper article.
The defense Lawyer Oscar Stilley has publicly stated
this was the facts of the matter on Pastor Butch Paugh's shortwave
radio broadcast Thursday night, 18 January 2007.
Put Wayne Fincher on the stand in his own defense and he
will prove he has not broken any of the laws of this
land! Judge Hendren and the ATFE know this, that
is why he was not allowed to speak or enter evidence to
prove the constitutionality and lawfulness of his
actions. The Judge and the Federal government are
in the wrong and they know it! We must give the
Arkansas Democrat Gazette credit for publishing the fact
that Hendren barred the defense lawyer from introducing
evidence from the U.S. Constitution. We must add
here that the Militia clauses of the Arkansas
Constitution were also barred from being presented to
the jury as evidence in this so-called trial.

own machine guns and sawed-off shotguns.
Fincher was arrested Nov. 9 after federal agents seized
15 illegal machine-guns and sawed-off shotguns during a
search of his Washington County home.
All
of the guns were examined and found to be in working
order.
"Our
strong belief in God will get us through this," said
Wanda Walker, Fincher's sister. "This isn't the
last of Hollis Wayne Fincher. We believe that
justice will be done in his case."
There
is no Justice in US Federal Courts!

The fact is the judge would not allow it .......
Take note of the fact that neither Wayne Fincher nor his
lawyer were allowed to argue their case. Nothing
from either the U.S. Constitution nor the Arkansas
Constitution was allowed to be presented as arguments or
evidence by either Wayne Fincher or his lawyer.
Wayne Fincher was not allowed by the Federal Judge to
take the stand in his own defense, and this same black
robed minion of tyranny would not even allow the defense
attorney to tell the jury that Wayne was barred by the
judge from speaking in his own defense and/or that
crucial evidence was being withheld from the jury. This
was a kangaroo court! The U.S. Federal government
cannot allow such arguments to be openly aired and
contended in Federal court because the Federal
government and Federal law enforcement are outlaws and
not in compliance with the U.S. Constitution, and this
fact can and would be proven in open court if such cases
were not squelched by tyrannical black hearted judges
backed by an evil and oppressive police state.
Evidence and testimony were unlawfully suppressed and
the facts hidden from the jury. The jury was
not presented with the facts about this case, and
was coaxed, cajoled, coached and coerced into coming
back with a guilty verdict!

beliefs, actions, and stand taken by Fincher and the
Militia of Washington County, Arkansas are in absolute
and total compliance with the 'laws of the land', it is
the U.S. Federal government that is breaking the law and
imposing tyranny!**

picks up the story, "A
lawyer whose client is on trial for having "militia"
weaponry says he'll ask questions and raise arguments
about the 2nd Amendment, and then let the judge rule
whether or not the Bill of Rights can be discussed in a
federal courtroom these days. A federal prosecutor in
the Arkansas case against Hollis Wayne Fincher, 60,
who's accused of having homemade and unregistered
machine guns, has asked the judge to censor those
arguments. But lawyer
Oscar Stilley
told WND that he'll go ahead with
the arguments. "I'm going to ask questions, what else
can I say?" he said. "There is a 2nd Amendment,
and it means something, I hope."
"His (Fincher's) position is that he had a legal right
to bear arms that are suitable and customary to
contribute to the common defense. If it's a militia
army, it's what customarily would be used by the
military suitable for the defense of the country,"
Stilley said."

I am of the opinion that in this country there shouldn't
be such a thing as an "illegal" firearm. The right to
bear arms should be self explanatory. Even if you don't
agree with the Second
Amendment or our right to bear arms I don't think you
can agree with the government's
overzealous prosecution of the case where it has tried
to limit Fincher from
making constitutional arguments at
trial.
What kind of crap is that ?
Doesn't everyone
have the constitution as a defense?
